  • Uncontested Divorce

An uncontested divorce is a divorce case where the parties are in full agreement to all the provisions of the divorce before the petition for divorce is filed. In an uncontested divorce, both parties sign all of the necessary pleadings and agreements needed for filing the uncontested divorce with the superior court usually located in the county of the defendant. If the parties disagree on any material aspect of the divorce - an uncontested divorce is not possible.

  • Contested Divorce

When a married couple cannot agree on all the necessary provisions of a divorce agreement, the only way a divorce can be granted is for one of the parties to file a contested divorce case. The parties may disagree on any combination of the following: division of assets & property / division of debts / the payment of alimony / child support / child custody & visitation / whom should pay the attorney’s fees in a case / whether or not there should even be a divorce.

In Georgia, there are several ways you can put an end to your marriage:

  • Annulment voids the marriage
  • Separation must occur before the divorce
  • Divorce ends the legal connection between spouses (You must reside in the state of Georgia for six months before a divorce can be granted)

The type of divorce that you file for will dictate what much of the process looks like. You can choose between fault grounds, no-fault grounds and abandonment.

If you would like to avoid a trial in court, you should not file for a contested divorce, and instead opt for an uncontested divorce, in which you and your spouse will agree on all of the issues that must be resolved in the divorce.

Once you are granted a divorce, the agreement will typically address several important features:

  • Property and debts will most likely be distributed equitably (not necessarily equally).
  • Alimony may be awarded as a lump sum or periodic payment plan.
  • A parenting plan will be filed if you have children. The plan will delineate terms for custody and visitation and child support.
